Terms, Warranty & Repairs

These Terms and Conditions ("T&Cs") govern the relationship between Laher Design ("Laher Design," "we," "us," or "our") and our customers ("you," "your," or "Customer") concerning the provision of bespoke jewellery design services and related products.

 

1. Design Satisfaction

1.1. At Laher Design, our primary goal is to ensure that you are 100% satisfied with the custom design we create for you. We understand that each piece of jewellery we make is unique and tailored to your specific tastes and requirements.

1.2. If, upon receiving your custom-designed jewellery or stock piece, you are not fully satisfied with the design, please notify us within 30 days of delivery. We will work closely with you to further develop the piece and address any concerns you may have.

1.3. To help us understand your concerns and improve the design, we may ask you to provide specific feedback or additional information. We encourage open communication throughout the design process to ensure the best possible outcome.

1.4. In the unlikely event that we are unable to achieve a design that meets your satisfaction, we will provide a refund as a final solution. We are confident in our ability to create a beautiful piece that meets your expectations.

 

2. Payment

2.1. A deposit is required upon commissioning a custom design project with Laher Design. The deposit amount will be specified in the initial project agreement.

2.2. The remaining balance is due upon completion of the project, before the delivery of the final product. Failure to pay the balance may result in the withholding of your custom piece until payment is received in full.

 

3. Cancellations and Refunds

3.1. If you are not satisfied with the final design, we will work with you to address any issues and make necessary adjustments as outlined in Section 1 (Design Satisfaction).

3.2. In the event that we cannot reach a satisfactory resolution, we will offer a refund as a final solution. The amount refunded will be determined on a case-by-case basis, taking into consideration the extent of work completed, materials used, and any other relevant factors.

High-Priced Items

3.3. For high-priced items involving significant capital outlay for diamonds or gemstones, we will work with you to repurpose the diamond or gemstone if you are not satisfied with the final design. Please note that repurposing the diamond or gemstone may take some time, as we may need to wait for a suitable opportunity to resell it. 

3.4. In such cases, we will make every effort to minimise any financial impact on you, but we may need to retain a portion of your payment to cover our costs until the diamond or gemstone can be resold.

 

4. Intellectual Property

4.1. All custom designs, sketches, images, and ideas created by Laher Design are the intellectual property of Laher Design and may not be reproduced, copied, or used for any purpose without our written permission.

 

5. Resizing, Warranty and Repairs

5.1. You will receive a follow-up upon receiving your item with instructions on how to organise a resize if need be. All resizes are free of charge, as we want your piece of jewellery to fit perfectly.

5.2. Laher Design offers a lifetime warranty on all jewellery, covering defects in materials and workmanship. This warranty does not cover damage due to normal wear and tear, accidents, or improper use. 

5.3. Our core policy is to ensure that your jewellery remains in impeccable condition for a lifetime. We take pride in our craftsmanship and will cover any necessary repairs to the metal and setting of your bespoke engagement ring. As experienced jewellers, we have the expertise to fix and maintain the structural elements of your ring. Included in this policy, is complementary professional cleans and polishes at the Laher studio.

5.4. Please note that our warranty does not cover damage to the gemstone or diamond. Repairing gemstones and diamonds requires specialised skills and equipment that go beyond the scope of general jewellery repair. If your gemstone or diamond sustains damage, we can facilitate the repair and resetting of the stone; however, this may incur an additional cost in some cases. 

5.5. If your jewellery requires repair, please contact us to arrange an appraisal for repair.

We want to emphasise our dedication to your satisfaction once more. Our warranty and repair policies apply to damage incurred after you have received your item. However, we are committed to working closely with our clients to ensure that you are fully satisfied with the resolution. Unlike many industry standards designed to shield jewellers from additional financial liability, our approach is different. We pledge to go above and beyond to ensure you feel that a satisfactory resolution has been reached. Hold us accountable to this promise.

 

5.5. Stones Falling Out

5.5.1. Accent Stones (Side Stones): In the unfortunate event that any accent stones (side stones) fall out due to becoming loose in the setting, we are committed to providing you with exceptional service. We will replace these accent stones free of charge. Please contact us immediately if you notice any loose accent stones or if they fall out, and we will arrange the replacement promptly.

5.5.2. Centre or 'Feature Stones': At Laher Design, we take utmost care in setting your centre or 'feature stones' securely prior to delivering your jewellery. However, due to the nature of jewellery usage, unforeseen circumstances may arise. We highly encourage you to insure your piece of jewellery before leaving our studio to safeguard against any potential loss of these valuable stones.

5.5.3. Insurance Recommendations: Jewellery insurance provides protection against loss, theft, and damage to your precious jewellery, including the centre or 'feature stones.' We recommend consulting with a reputable insurance provider to obtain comprehensive coverage for your bespoke engagement ring. The industry standard here in Australia for jewellery insurance is Q-Report and you will receive an information pack on setting this up, during your order. Having insurance coverage will provide you with peace of mind, knowing that your treasured piece is protected under various circumstances.

 

6. Limitation of Liability

6.1. To the extent permitted by law, Laher Design's liability for any claims arising out of or related to these T&Cs, our services, or products shall be limited to the total amount paid by the Customer for the specific custom jewellery piece giving rise to the claim.

 

7. Changes to Terms and Conditions

7.1. Laher Design reserves the right to modify these T&Cs at any time. We will notify you of any significant changes by posting a notice on our website or via email. Your continued use of our services following such notification constitutes acceptance of the modified T&Cs.

 

8. Governing Law

8.1. These T&Cs and any disputes arising out of or relating to them shall be governed by the laws of the jurisdiction in which Laher Design operates, without regard to its conflict of law provisions. Any legal action

Returns Policy for Engagement Ring Pieces

Given the unique nature of these pieces, please note the following regarding our returns policy for engagement ring pieces:

  • No Direct Returns: Due to the custom nature of our engagement rings, we do not accept direct returns on these items. Each piece is made to order, ensuring that your ring is as unique as your story. We encourage you to reach out to us with any concerns or questions before making your purchase to help you select the perfect piece.

  • Resale Assistance: While we cannot accept direct returns on engagement ring pieces, we understand that circumstances can change. If you find yourself needing to sell your custom engagement ring, Laher Design offers a unique service to assist you. We will do our best to resell your item through our company, leveraging our network and platforms to find a new owner who will cherish the piece as much as you have. Please note that repurposing the diamond or gemstone may take some time, as we may need to wait for a suitable opportunity to resell it. 

3.4. In such cases, we will make every effort to minimise any financial impact on you, but we may need to retain a portion of your payment to cover our costs until the diamond or gemstone can be resold.

5.5.1.
